Istemal ke liye taiyar kar da zewarat ki zakat

Sawal:

1994 me Shaadi ke mauke per mere sasur ne Meri biwi ko (560) gram vazan (wait )sone ka zewar Diya.

Aur jab Meri biwi ke yahan paidaish Hui to rishta daron ki jaanib se kuchh sone ke tukde batore hadiya.( Gift ) mile.

Aur usi Tarah maine 1994 se 2004 ki muddat ke dauran apni biwi ke liye kuchh zewar kharida.

Ab Meri biwi ne mujhe bataya hai k. hamare zimma 240 gram Sona bataur zakat Ada karna hoga.

Mera sawal yah hai k :

Kya main in teenon kism k  sone ki qimat. ( zakat )

Alhamdulillah.

Awall:

Zeeb wa zinath aur pahnane ke Liye taiyar karda zewar me zakat ke masle me olma e karaam ikhtilaf rakhte Hain.

Ahnafh  ( Hanafi )is me zakaat ko wajib karar dete aur jamhoor ullma karam mallkiya shafayi  aur hnabilaa wajib qaraar nahi dete .

Ahenaf ka qaul rajeeh hai, uske Ke  kayi ek Dalaill hain:

1- sone.( gold ) aur

Chandi ( silver ) mein zakat ke vajub ke Dalail ka umoman 

Jin  me istemal ke liye zewar vagairah me Koi Tafarikh Nahin hai.

2- Nabi sallallahu alaihi wasallam ki biwi

Ayiesha Razi Allahu Tala anha  bayan Karti Hain ke mere pass

Rasule Kareem sallallahu alaihi wasallam Aaye to mere hath mein chandi ki do badi badi anguthiyan ( ring ) dekhkar farmane Lage:

Aye Ayiesha yeh kya ?

Tu maine arrz kiya:

Ay Allah Tala ke rasul sallallahu alaihi wasallam Maine yah isliye taiyar ki hain Taki aapke liye inse bnao singar aur zeenat ikhtiyar karun, to rasule Kareem sallallahu alaihi wasallam ne farmaya:

” Kya Inka zaka deti ho ?

Mai ne arrz kiya : nahi,

” Tere Liye yah aag hai “

Sunana Abu Dawood aur hadees number (155 )

Allama allbani rahmhullah

Taa’la ne ise sahih Abu Dawood me sahih karar Diya hai.

Allfat hath Badi anguthi, ( big ring ) aur  Alwarq  chandi ko kahate Hain.

3- Umar bin Shoaib an abiya an Jeddah bayan karte Hain k

Ek aurat Nabi Karim sallallahu alehi vasllam ke pass ayi aur uske sath uski beti thi ,

Aur uski beti ke hathon mein sone ke do mote mote kangan  (bangles )the ,to rasule Karim sallallahu alaihi vasllam ne us se  farmaya:

” Kya iska jakat deti ho ?

To woh khene lagi: Nahin,

to rasule Karim sallallahu alaihi vasllam ne farmaya :

Kya tumhein yah achcha lagta hai ki Allah Tala iske badle me tujhe Roze kayamat

Aag 🔥k  kangan pahnaye?

Raawy kahate Hain k : to use aurat ne donon kangan utaar diye aur Nabi Karim sallallahu alayhi wa sallam ki taraf feink kar kahane lagi : yah duno Allah Tala aur uske rasul sallallahu alaihi vasllam ke liye hain “

Sunana Abu Dawood hadees number (1563 ) sunan nisayi hadis number (2479 ) allama all bani rahma Allah Ta ala ne sahih Abu Dawood me ise Hassan qarar Diya hai,

Duvam :

Jab aapke ilm me aaya ke is mein zakat wajib hai use waqt se lekar aap per zakat ki adayegi wajib hai,

Lekin  woh sall Jin me aapko yeh ilm nahin tha ke zewar per zakat wajib hai,

In barson ki zakaat nikalna  lazim Nahin hai,

Shaikh ibne baaz rahmatullah Tala se aisi aurat ke mutaaliq dariyaft  Kiya Gaya jiske pass pahnane ke liye zewar tha.

Aur uske pass Kayi baras tak Raha, fhir use ilm hua k is me  zakat wajib hai,

Tu kya ise guzashta sab barson ki zakat nikalna lazim hai ?

Tu shaikh rahmulla Tala ka jawab tha :

Jab se use ilm hua k istemal k liye banaya jaane wale zewar me zakat vajib hai,

Use us waqt se zakat deni lazim Hogi,

Lekin woh baras jin me use zewar per zakat ke vajub ka ilm Nahin uski aap per zakat Nahin hai,

Kyunki ilm hone ke bad

Ihkaame shariyat lazim hote Hain”

Aur us jaise hi ek sawal k jawab me shaikh ne kaha :

“Use chahiye ke woh mustaqbill mein har sal uski zakaat Ada Kare agar woh Nisaab ko pahunchta ho…… Lekin woh baras Jo us mein zakat ke wajub ka ilm hone se kabll guzar chuke hain is me

Jihaalat aur subha Ki Bina per kuchh Nahin hai,

Kyun k baaz ahale ilm pahnane wale zewar me zakat k wajob ke qayill Nahin hain

Lekin rajeeh  yahi hai k jab nishab takaur  pahunche aur use per saal mukmmal ho jaaye to us mein zakat wajib hai,

Kyunki uski kitab o sunnat mein dalil milati hai.

Suwam :

Istemal ke liye taiyar kar da zevrat jab sone aur chandi ke hon to usmein zakat wajib hai,

Lihaza is Bina per agar to aapke kharide hue zevrat sone aur chandi Ke Nahin to usmein zakat Nahin. Mazeed tafseel ke liye aap sawal number  (40210 ) ke jawab ka mutaliya Karen.

Charom :

Zakat zwarat Ke Malik ke zimma hai na Ke 

(khavind . Husband )ke imma

Sheikh ibnebaaz rahmulla Tala kahate Hain:

“Zewrat ki zakat uski Malika per hai, aur agar uska

(khavind.husband ) ya koi aur uski ijaazat se zakat Ada Kare to usmein Koi harj Nahin,

Aur (sone. gold )se hi zakat nikaalni wajib Nahin,

Bal ke har baras sall

(every years ) mukmmal hone per market mein sone gold & silver ki aur chandi ki qimat ke mutabik uski qimat se bhi zakat nikaali ja sakti hai”

Dekhein: fatwaa islamiya ( 85/2).

Lekin….. Agar aap donon ko diye Gaye hadiya jaat aur Tohfe gifts 🎁 main se apne apna hissa apni biwi ko Nahin Diya to fhir agar woh  nissab Jo ke  ( 85 gram )Sona hai

Tu aapko uski zakat nikalna

Wajib hai.

Zakat ki meqhdaar dhyie fisad

(%2.5 ) hai, lihaza 100 gram mein se dhayi gram (%2.5 )

Zakat nikaali jayegi.
